NIQ Discover Platform Privacy Notice

NielsenIQ cares about your privacy and is committed to handling your data in an open and transparent manner. This Privacy Notice (“Notice”) describes how the NIQ Discover (“Platform”) made available by Nielsen Consumer LLC (​​“NIQ”, “we”, “us”, “our”) handles the personal data we collect and the rights you may have over this information. We collect data through our website (connect.nielseniq.com) and our interactions with you as an NIQ customer or Platform User (”User”) (collectively, our “Services”). This Notice applies only to data collected by us in connection with your use of and/or interaction with the Services and through our performance of any activities that form part of the operation and delivery of the Services.

NIQ belongs to the group of companies listed here, which together form the “NIQ Group.” Unless this Notice is displayed for any other services, including software applications made available by us, the Notice does not apply to any other product or service owned by NielsenIQ.

In this Notice, “Personal Data” means any information relating to an identified or identifiable individual (one who can be identified, directly or indirectly, reference to an identifier). This includes details like name and contact information (email address, phone number, etc.). The term also includes “personal information,” or similar terms as defined in applicable law. Personal Data that has been anonymized in such a way that the data subject cannot be identified or can no longer be identified (anonymous data) is no longer considered Personal Data and no longer governed by this Notice.


Notice at collection of personal data

This Notice at Collection provides some key information about our privacy practices: the categories of Personal Data we collect; how we obtain, share, and maintain Personal Data; and how you can instruct us to stop sharing your Personal Data. We process the below data categories of data for all Platform Users, Employees of the NIQ Group (“Employees”), and Prospective Users (“Prospective Users”). 

  • Identifiers, collected directly from you or your employer. 
  • User Account Data, including name, username and password (for non – federated customers), company name, country, and language. 
  • Internet or Other Electronic Network Activity Information, collected automatically from you (i.e., passively when you visit and/or interact with our Services).   
  • Access Log Data, including browser type and version, device operating system type and version. 
  • Analytics Information, collected automatically from you (i.e., passively when you visit and/or interact with our Services). 
  • Platform Usage Data, including Amplitude Analytics: IP address, device manufacturer and model, device operating system type and version, date and time of login and logout, login frequency, number of user logins over time, duration of visit on a subpage within the Platform, SMTP-ID, browser type, and any User interaction with the Platform. 
  • Approximate Location Information, collected automatically from you (i.e., passively when you visit and/or interact with our Services).   
  • Access Log Data, including device city and country and location as inferred from IP address. 
  • Sensory Information, collected directly from you. 
  • Audio, Electronic, Visual, or Similar Interaction Data, such as User messages, comments, and uploads (photos, videos, recordings, etc.). 

As is true of most platforms, we need to process your information to provide access to and functionality of the Platform. We will use your data for the purpose(s) for which it was collected or provided to us or as otherwise communicated at the point of collection. We do not use your Personal Data to advertise, promote, or market third-party goods or services to you. Additionally, we will not license, publish, or sell Personal Data collected from or about you. 

Our Services use Google Analytics to collect Personal Data, including identifiers and information about your activity on our Services. You can opt out of the use of this technology through the Google Analytics opt-out browser add on, your Google Ad Settings, your device’s Ad Settings for mobile apps, and the NAI’s consumer opt out

Exercising Privacy Rights: In accordance with applicable law, you may have certain rights over your Personal Data. Though, because we do not sell or share Personal Data, nor do we permit its use for targeted advertising, we do not offer an ability to opt out/withdraw consent from such data processing.  

Otherwise, if you are interested in exercising one or more of your rights, please contact us at connect.privacy@nielseniq.com. Because we want to avoid taking action regarding your Personal Data at the direction of someone other than you, please note that we may request information verifying your identity before we can give effect to these rights. When visiting our website, you may also choose to enable a browser-based signal that automatically communicates your preferences, such as the Global Privacy Control (“GPC”). Where required, we will process the GPC signal as a valid privacy request.   

Retention: We will retain your Personal Data for as long as reasonably necessary to fulfill the purposes described in this Notice, or to comply with our legal obligations, resolve disputes, and enforce our agreements. Our data retention periods reflect several factors, including our relationship with Users of our Services, the nature and sensitivity of the Personal Data, and what is reasonably necessary and proportionate to provide and improve our Services. When we engage third parties, they will store Personal Data on their systems for as long as is necessary in connection with their provision of services to us in accordance with our service provider contracts.  


  1. LEGAL BASES FOR PROCESSING PERSONAL DATA AND STORAGE PERIODS 

As a Platform provider, we may collect different types of Personal Data that you provide to us directly, as well as automatically through your use of our Services, and from third parties. The categories of Personal Data processed are detailed in the chart below. Please note that a specific piece of Personal Data may fall into one or more of the categories.  

In certain circumstances, we may collect Personal Data about you from sources other than yourself, for example your employer. In addition to the below, we may also use your Personal Data for other purposes disclosed at the time you provide your information or otherwise with your permission.

2. HOW WE DISCLOSE PERSONAL DATA 

We may disclose Personal Data (in accordance with applicable law) for the purposes described above to other companies within the NIQ Group, with our service providers and other third parties. Within the NIQ Group, Employees and departments with a “need to know” basis have access to Personal Data only to the extent necessary for the described purpose. When we disclose Personal Data, we take contractual, technical, and organizational measures that are designed to limit the recipients’ use to specific purposes that are consistent with this Notice and in accordance with applicable law. 

Recipients of Personal Data. We may transfer Personal Data to recipients, who are typically processors handling the Personal Data only in accordance with our instructions. These third parties belong to the following categories of recipients: 

  • Our Customers (Your Employer). Upon request, we will provide your employer with reports detailing how you and other employees at your company use the Services. These reports may include data relating specifically to you (i.e., your name, company email address, and details about your use of the Services, such as, a history of your access times, duration of your visits, pages viewed, and information downloaded). 
  • Our Corporate Affiliates, which include our parent company and its subsidiaries listed here, the NIQ Group. 
  • Our Service Providers. We disclose your Personal Information to our service providers that provide business, professional, or technical support services to us, help us operate our business and the Services, or administer activities on our behalf.  
  • Analytics Providers. We may make available information from our Services to allow our analytics providers to help us understand how visitors use the Services and how to improve them. We also collect information about your interactions with emails we send to you, such as whether you forwarded the message or clicked through to our website after opening it.

In certain circumstances, we may disclose Personal Data to: 

  • Governmental, Regulatory, and Public Authorities. We may disclose Personal Data to government and law enforcement authorities to comply with legal or regulatory obligations or requests. 
  • Relevant Third Parties as Part of a Corporate Transaction. In the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with a bankruptcy or similar proceeding), we may disclose or transfer Personal Data to certain third parties, such as the acquiring entity and its advisers. 
  • Other Third Parties. We will disclose your Personal Data to other third parties at your direction or with your consent. Additionally, we will disclose Personal Data as necessary or appropriate to: (a) comply with applicable law; (b) enforce our terms and conditions; (c) protect our operations; (d) protect our rights, privacy, safety, or property, and/or those of you or others; and (e) allow us to pursue available remedies or limit damages that we may sustain. 

In addition, we may disclose Personal Data for other reasons that we will describe at the time of information collection or prior to disclosing the information.  

To the extent permitted under applicable law, we may deidentify, anonymize, or aggregate Personal Data so that it will no longer be considered Personal Data. Once deidentified, we do not attempt to reidentify the data. We ensure it will not be reidentified by implementing strict technical and organizational measures to prevent reidentification and use contractual measures to ensure third parties adhere to the same non-reidentification commitments. Our use and disclosure of deidentified, anonymized, or aggregated information is not governed by this Notice.  

3. TRANSFERS OF PERSONAL DATA 

Due to the international nature of our business, it may be necessary for us to transfer your Personal Data to other companies within the NIQ Group and to third parties outside the jurisdiction in which you reside. For this reason, we may transfer your Personal Data to countries that may not have the level of data protection that you enjoy under your jurisdiction (“Third Countries”). This can, for example, result in impeded enforcement of privacy rights, a lack of control over further processing, and access by state authorities.  

Within the NIQ Group, we have concluded an intra-group data transfer agreement with the relevant transfer mechanisms (for example, standard contractual clauses of the European Commission) and additional safeguards, if necessary, to ensure an adequate level of protection for your Personal Data when it is transferred to Third Countries.  

Insofar as we transfer your Personal Data to other recipients in Third Countries, we ensure that your data is protected by adequate safeguards recognized by your jurisdiction (for example, by concluding standard contractual clauses of the European Commission or by means of binding corporate rules of our business partners) and supplementary measures, as necessary. 4. COOKIES AND OTHER TRACKING TECHNOLOGIES 

Our Services use cookies and other tracking technologies. When you visit and interact with our Services, we or our third-party analytics partners and service providers may use a variety of technologies, such as cookies, tags, SDKs or scripts (collectively, “Cookies”), to collect information about how you use our Services. This includes information about your browser or device, approximate geographic location, and your use of the Services (e.g., the pages of our website you visit and how long you spend browsing them). 

These technologies access and/or store information in your browser or on your devices to distinguish you from other users, make your site navigation more efficient, help remember your preferences, enhance your browsing experience, and improve the use, security, and functionality of our Services. When third parties place their own cookies, they may create identifiers that they associate with you or your device. They may then combine this information with other data sources for analytics or advertising purposes. 

Our Services may use both first-party Cookies (which are set by and send information only to us) and third-party Cookies (which are set by our partners and service providers and send information about your device to other companies that recognise the Cookies). We use session Cookies, which are only stored for individual online sessions and are deleted when you close your browser, and persistent Cookies, which are deleted when they reach their expiry date or are deleted by the user. We use some Cookies only with your consent. Where we rely on consent, you can withdraw your consent at any time with effect for the future, e.g. by changing your cookie preferences from settings. 

We (and our partners and service providers) may use the following types of cookies:    

  • Performance Cookies. These Cookies allow us to track visits and usage so that we can measure and improve the performance of our Services. They help us understand which pages are the most or least popular, or to record error messages on the website. All analysis based on this information is aggregated. 
  • Strictly Necessary Cookies. These Cookies are necessary for the functioning and management of our Services and cannot be disabled in our systems. They are usually set based on your input, such as when you set your Cookie preferences, log in, or fill out forms.  

We place Strictly Necessary Cookies to provide you with a tele media service or other equivalent information service expressly requested by you. The subsequent processing of these Cookies is based on our legitimate interest to provide you with a technically optimized, user-friendly and appropriate Services, or your consent (as applicable). 5. AUTOMATED DECISION MAKING AND PROFILING 

We use automated processes in the delivery of our Services. To the extent that these activities constitute automated decision making or profiling, we take steps to do so in a fair and non-discriminatory manner. We do not process your Personal Data for profiling that produces a legal or similar significant effect, such as a decision to offer or decline your request for employment. 

6. PRIVACY RIGHTS AND CHOICES 

The Discover Platform, made available by Nielsen Consumer LLC, is the controller of Personal Data collected from or about you. In accordance with applicable law (and subject to certain exceptions), you may have certain rights in relation to your Personal Data, including the right to: 

  • Access your Personal Data (including a copy in a portable format). You may have the right to request a privacy report detailing the Personal Data we maintain about you and the purposes for doing so, unless your request proves impossible or would involve disproportionate effort to fulfill. Under certain conditions, you may request that we transfer your Personal Data to another organization, or directly to you, but we may not be required to respond to your requests “to know” or access specific pieces of Personal Data more than twice in any 12-month period.  
  • Request a List of Third Parties, though we will not license, publish, or sell Personal Data collected from or about you, and we are not required to provide the names of NIQ Group customers or other trade secrets. 
  • Correct or Rectify inaccurate Personal Data that we maintain about you, subject to appropriate verification. 
  • Delete or Erase the Personal Data that we maintain about you, under certain conditions. We may be unable to delete your information without also deleting your Platform account. 
  • Restrict or Limit Processing of the Personal Data that we maintain about you, under certain conditions. This includes a right to restrict the use or disclosure of your Personal Data of a sensitive nature, but it is not a typical practice of ours to collect or maintain your sensitive information.  
  • Object to Processing the Personal Data that we maintain about you based on our legitimate interest, under certain conditions. We will no longer process your Personal Data unless we can demonstrate compelling legitimate grounds for the processing which override your interests or for the establishment, exercise, or defense of legal claims. 
  • Opt Out of Sales, Sharing, or Targeted Advertising (as defined by applicable law) at any time, but because we do not process your Personal Data for these purposes, we do not offer an ability to opt out. 
  • Opt Out of Automated Processing or Profiling resulting in a decision based solely on automated processing, including profiling which produces legal effects concerning you or similarly significantly affects you. As a reminder, we do not process your Personal Data for these purposes.  
  • Withdraw Consent at any time where we rely on consent as the legal basis, with effect for the future, by contacting us at or by using the contact information below.  
  • Appeal or Lodge a Complaint in the event of a suspected infringement of applicable data protection laws, you may appeal our decision directly with us or lodge a complaint with a supervisory authority. 

We empower and support the exercise of your rights. At any time, you may request or assert any of the rights listed above by selecting Your Privacy Rights from our website or by emailing us at connect.privacy@.nielseniq.com. We will assess any request after confirming your identity and work to respond within applicable legal deadlines, and let you know if we need additional time. If you believe there has been a violation of your privacy rights, please contact us or the supervisory authority. 

We may take steps to confirm your identity before responding to your request by asking you a series of questions about your previous interactions with us. We may decline a request (other than an opt-out request) if we are unable to confirm your identity (or an agent’s authority to make the request) or confirm the Personal Data we maintain relates to you. 

We will not discriminate against you if you decide to exercise your privacy rights. 

7. AUTHORIZED AGENT REQUESTS

Only you, or someone legally authorized to act on your behalf, may submit a request related to your Personal Data. 

In accordance with applicable law, you may authorize someone to make a privacy rights request on your behalf (an “Authorized Agent”). To confirm their authority, Authorized Agents need to demonstrate that you’ve authorized them to act on your behalf. Authorization must be done in writing and signed, and the writing must identify the agent and explain what request they are authorized to make. Your Authorized Agent must include a copy of this writing or a copy of a valid power of attorney with the request. The NIQ Group retains the right to request confirmation directly from you, confirming that the agent is authorized to make such a request, or to request additional information that is necessary to identify you.

8. DATA SECURITY AND EXTERNAL LINKS

We maintain a comprehensive information security program with administrative, physical, and technical safeguards to maintain the confidentiality, integrity, and accessibility of your information. However, as no transmission of information over the internet is absolutely secure, we cannot guarantee the safety of your information.  

Our Services may have links to third-party services, which may have privacy policies that differ from our own. We are not responsible for the practices of such sites and encourage you to review their practices for more information.   

9. PERSONAL DATA OF CHILDREN

We understand the importance of protecting the privacy of children, especially in the online environment. The Services are not designed for or intentionally targeted at children, and we do not intend to collect, maintain, or disclose Personal Data about anyone under the age of 18. If we become aware that we have collected Personal Data relating to a child, we will delete it or take other reasonable steps to comply with applicable law. We do not knowingly sell or share information about individuals under the age of 18. 

10. REVISIONS TO THIS NOTICE

We reserve the right to change, modify, add, remove, or otherwise revise portions of this Notice at any time, for example as our Services develop and evolve, to comply with legal requirements, or to address changes in our business practices. When we do, we will post the revised Notice to our website and Platform. Your continued use of our website or Platform following the posting of changes to these terms means you acknowledge these changes. If we change the Notice in a material way, we will provide appropriate notice to you and update the date at the top of the Notice.
