NIQ CONSUMER PANEL SERVICES PRIVACY NOTICE

For decades, NIQ has set the standard for global market and consumer insight research, using representative population samples to inform our customers – including manufacturers, retailers, digital platform operators, non-profits, and governments – about what consumers watch, listen to, and buy, how consumers use on-demand platforms as well as their preferences and behaviors. Participation in the NIQ Consumer Panel (the “Panel”) helps us create our consumer insight solutions that, in turn, help our customers understand consumers’ usage patterns, purchasing decisions, shape product offerings, and refine programming and advertising content.

In this Privacy Notice (“Notice”), “NIQ” (“we,” “our,” or “us”) refers to the NIQ data controller processing Personal Information related to your or your household’s Panel participation or use of our Platforms. Click here to identify and learn more about the controller for the country in which you reside. These companies together form the “NIQ Group.”

This Notice describes how we use, share, and process the Personal Information we collect through our “Platforms,” including: the Panel, Panel websites (each a “Website”), any NIQ-provided tablet device or scanner (a “Scanner”), and the Nielsen Consumer Panel mobile application (the “App”). Regarding your interactions with us as Website Visitors and Panelists:

  • You are a Website Visitor when you visit any of the publicly accessible areas of a NIQ website that links to this Notice.
  • You are a Panelist when you (and your household) enroll in the Panel, including when you visit areas of a Platform that are accessible only to enrolled Panelists. NIQ processes Personal Information associated with the App under the practices that apply to Panelists.
  • If you are a Website Visitor and a Panelist, NIQ processes your Personal Information according to the role that you play in a given interaction with us, including your interaction with our tracking technologies (such as cookies or pixels) – more information is available in the Cookie Notice linked from the Platform.

USA Panelists: Our Health Data Notice supplements this Notice and describes our privacy practices as related to consumer health data.

Your household’s participation in the Panel is always voluntary. Be sure each member of your household reviews this Notice carefully. If you have any questions about the Panel, this Notice, or your data, refer to our contact details below.

In this Notice:

  • Personal Information” means any information relating to an identified or identifiable individual (one who can be identified, directly or indirectly, by reference to an identifier). The term also includes “Personal Data,” or similar terms as defined in applicable law.
  • Sensitive Personal Information” means Personal Information that, if disclosed, could lead to identity theft, fraud, or significant harm to an individual. This includes information revealing an individual’s racial or ethnic origin, political opinions, religious or philosophical beliefs. The term also includes “Special Category Personal Information,” or similar terms as defined in applicable law.

NOTICE AT COLLECTION OF PERSONAL INFORMATION

Personal Information Categories, Processing Purposes, Legal Bases, and Storage Periods

This Notice at Collection provides some key information about our privacy practices: the categories of Personal Information we collect; how we obtain, share, and maintain Personal Information; and how you can instruct NIQ to stop sharing your Personal Information.

For transparency purposes, note that we do not share individuals’ names, addresses, or other directly identifiable information with our customers for purposes of directly marketing, targeting, or selling to you. We never share your directly identifiable information with telemarketers.

We automatically collect the following categories of Personal Information from Platform areas accessible to Website Visitors for troubleshooting and security logging purposes to prevent, detect, and investigate suspicious activities. Our legal basis for processing this data is our legitimate interest in providing, monitoring, and improving service functionality and security, or with your consent to the extent we use optional cookies. We store these logs for a short period, not exceeding 6 months to 1 year, then the data is deidentified or deleted.

  • Identifiers, including your Internet Protocol (“IP”) address and your user agent string (identifying operating system and browser type and version).
  • Internet or Other Electronic Network Activity Information, including the time and date of your visits to our Platforms and other information that is stored in cookies and similar technologies.

In addition to the information collected from Website Visitors, we collect the following categories of Personal Information from Panelists and collectively refer to it as your Panel Data. Unless indicated otherwise, we collect and process Panel Data from you and your household with your consent and store it until you delete your account or request the deletion of your data, subject to our compliance obligations.

Identification Information, including the following categories:

  • Identifiers/Biographical Information, including your name, birth year, email address, household ID, country ID, login credentials, phone number, and addresses.
  • Location Information, based on the address you provide as a Panelist. We also collect approximate location information (city, region, country) based on the IP address assigned to the device that you use to access our Platforms.
  • Socio-Demographic Information, such as your age, gender, occupation, education, housing situation, marital status, and similar data about the other members of your household, including information about legally protected categories (in particular if your household participates in a study involving the healthcare industry), including:
    • Sensitive Personal Information that may be revealed through your Panel responses, such as your race, ethnicity, and health information.
    • Protected Classification Characteristics (under applicable law), including your age, race, gender, and sexual orientation that may be revealed through your Panel responses.
  • Commercial Information, including records of services you purchased, obtained, or considered through purchase receipts, sales receipts, Scanner results (scanned bar codes of products), App entries, and Panel responses as well as other purchasing or consuming histories or tendencies, including:
  • Behavior Information, such as when, why, or how you do things, such as how frequently you shop for groceries or use your computer, TV, or the Internet.
  • Preference Information, referring to the choices you make, such as which breakfast cereals you buy, which stations you listen to or watch, or the websites that you visit.
  • Internet or Other Electronic Network Activity Information, including the pages of our Platforms that you visit and the amount of time you spend viewing the Website or using the App, form field entries, IP address, push notification status, browser type, device type, operating system, and carrier. We collect and process this data automatically when you use our Platforms, unless you’ve indicated otherwise with your preference signals or opt-out options.
  • Technical Log and Usage Information concerning the App, the rewards site, and areas of the Website that are available to Panelists only. This data includes, for example, device information such as IP address, Media Access Control (MAC) address, unique device identifier such as IMEI number, Mobile Advertising ID (MAID), device manufacturer and model, operating system name and version.
  • Precise Location Information (Optional), for example, we may receive latitude and longitude of your mobile device through various means depending on your settings, including Global Positioning System (“GPS”), Bluetooth, or Wi-Fi signals and connections. We collect and process this data automatically when you choose to use the “Store Search” feature of the App.
  • Inferences about your interest in purchasing certain types of products or services based on the categories of Personal Information listed above.

We collect these categories of Panel Data for two main reasons. First, we need to process your data to provide NIQ’s customers with consumer insights. Insights or inferences may be drawn regarding your interest in purchasing certain types of products or services, based on analysis of the Personal Information categories listed above. Second, we provide our customers with market intelligence, analytics, datasets, and measurement products to help them understand their markets and prospective customers. With your consent, we will include your data in NIQ’s Consumer Segment Activation (“CSA”) product, which enables our customers to develop lookalike models and audiences for targeted advertising (further described in the CSA section below).

USA: We may “sell” or “share” (as those terms are defined in applicable U.S. law) some types of Personal Information to third parties. If you enroll as a Panelist, we may provide your Personal Information to customers such as e-commerce businesses, investment companies, consumer brands, media companies, and data brokers. To opt out/withdraw consent of the sale or sharing of your Personal Information collected through our Platforms (other than Panelist surveys), navigate to “Your Privacy Rights” within the footer of our Website or the “Settings” menu in our Platforms. You may also choose to enable a browser-based signal that automatically communicates your preferences, such as the Global Privacy Control (“GPC”). Where required, we will process the GPC signal as a request to opt out of sales through the Website.

Our Platforms use Google Analytics to collect Personal Information, including identifiers and information about your activity on our Platforms for our remarketing, impression, demographic, and interest reporting. You can opt out of the use of this technology through the Google Analytics opt-out browser add on, your Google Ad Settings, and your device’s Ad Settings for mobile apps.

Retention: We store your Panel Data until you either opt out of the Panel, delete your account, or ask us to stop processing it. If you opt out of the Panel, we will stop processing your Commercial Information for purposes other than servicing your account. We will otherwise retain your Personal Information for as long as reasonably necessary to fulfill the purposes described in this Notice, or to comply with our legal obligations, resolve disputes, and enforce our agreements. Our data retention periods reflect several factors, including our relationship with users of our Platforms, the nature and sensitivity of Personal Information, and what is reasonably necessary and proportionate to provide and improve our Platforms. Regarding the use and retention period of cookies, more information is available in the Cookie Notice linked from the footer or within the “Settings” menu on our Platforms.

1.         HOW WE COLLECT AND PROCESS PERSONAL INFORMATION

We collect Personal Information about you in several ways. Where a practice is specific to your interaction with us, we identify it below.

          A.       Information You Provide (Panelists Only)

During the recruitment and registration process or as part of a research study, we will gather data about you and other members of your household through the voluntary completion of our online recruitment questionnaire and other Panel registration activities.

During your household’s active participation in the Panel, we may occasionally invite you to voluntarily complete questionnaires or take part in surveys and research studies. These activities help us gain insights into your perspectives and preferences regarding everyday life, social and political topics, consumer products and behaviors, media usage, and purchasing patterns.

  • For example, we may request information about your favorite breakfast cereal brands, your grocery shopping habits (including timing, location, and frequency), and your opinions on statements like “I regularly go to the movies.” or “To conserve energy, I wash clothes more often at lower temperatures.” Through these questionnaires, surveys, or studies, you and other household members may voluntarily share additional details with us.

We also collect details about your household’s grocery and other product purchases as you share them with us via the App or other methods. This typically involves scanned product barcodes, uploaded receipt images, and purchase information that you manually enter in the App or through surveys.

We use your Panel Data for the following business and commercial purposes:

  • Platform Operation & Improvement. Operate, maintain, secure, and improve our Platforms and services. Ensure compatibility, system administration, and service functionality. Personalize user experience and analyze interactions for service optimization.
  • Panel & Account Management. Create and manage your account. Provide information about your participation, including reward redemption. Communicate with you about the Panel, Platforms, and related inquiries.
  • Communications & Marketing. Contact you about our services, events, and opportunities to participate in surveys and studies (with consent where required). Send updates, notifications, and personalized content.
  • Data Processing & Insights. Pseudonymize or deidentify data and create aggregated reports. Prepare analytics, insights, and statistics for customers. Support product development, market research, and service improvement.
  • Security & Compliance. Maintain Platform security and protect user data. Validate and update data as needed.
  • To develop lookalike models. (the frameworks in how we organize groups of consumers who are likely to be interested in certain types of products and services), lookalike audiences (new audiences we create to mirror the characteristics of our panelists), and segments for customers’ targeted advertising (distinct groups within our audiences, categorized based on specific criteria such as demographics, interests, behaviors, or geographic location), and to ensure that you (our panelists) are not targeted for direct marketing or sales purposes and are removed from any such audiences or segments

B.        Information We Automatically Collect (Panelists and Website Visitors)

Our Platforms use cookies and other tracking technologies to collect Personal Information from Panelists and Website Visitors. These technologies access and/or store information in your browser or on your devices to distinguish you from other users, make your site navigation more efficient, help remember your preferences, enhance your browsing experience, and improve the use, security, and functionality of our Platforms. When third parties place their own cookies, they may create identifiers that they associate with you or your device. They may then combine this information with other data sources for analytics or advertising purposes.

More information about tracking technologies and the rights you may have over this information is available in the Cookie Notice linked from the footer or within the “Settings” menu on our Platforms. To adjust your cookie settings, select “Your Cookie Choices” on the cookie banner or within the “Settings” menu.

          C.       Data Collected by NIQ Supplied Equipment (Panelists Only)

If a Scanner is provided to your household after joining the Panel to help your household share purchase data and other data with us, your household will use the Scanner to record the products that your household buys and share other relevant information with us (e.g., when you and other members of your household are away from home on holiday, business travel, etc.). The Scanner also records timestamps when you or another member of your household records purchases, completes a survey, or reads a message on the Scanner. Your household will receive additional details about the Scanner, including instructions on installation and use of the Scanner and its features, after joining the Panel.

D.        Information from Third-Party Sources (Panelists Only)

We may obtain data about you as a Panelist from other sources, generally relating to your demographic characteristics (what you watch, research, or buy) and your exposure to certain content or advertising. We also obtain data from third party panel providers who help us recruit our panels. This additional information helps us support customers who want to learn more about their final customers’ purchasing habits.

We may supplement the information we collect about you with data from a variety of external sources, including public databases and social media, manufacturers and retailers of products or services you use, authorized third-party websites and mobile apps, other research panels, Nielsen Connect measurement products, customer loyalty programs, and specialized data providers. This combined data helps us build a more comprehensive understanding of your preferences and behaviors.

          E.       Other Uses of Personal Information (Panelists and Website Visitors)

In addition to the purposes previously described, we use Personal Information from Panelists and Website Visitors, as permitted by law, to:

  • Communicate with you and respond to inquiries, including sending updates about our Platforms.
  • Detect, prevent, and address fraud, unauthorized access, and other unlawful or suspicious activities, while maintaining the security of our systems and business.
  • Comply with legal obligations and respond to lawful requests such as subpoenas or court orders.
  • Support business operations, including restructurings, sales, or transactions where Personal Information may be transferred as part of our assets.
  • Establish, defend, and protect our legal rights, privacy, safety, property, and those of others.
  • Fulfill any additional purpose disclosed at the time of collection or with your consent.

To the extent permitted under applicable law, we may deidentify, anonymize, or aggregate Personal Information such that there is no reasonable possibility of re-identifying you from the data used. Such deidentified data will no longer be considered Personal Information. Once deidentified, we do not attempt to reidentify the data and ensure it will not be reidentified by implementing strict technical, organizational, and contractual measures to ensure third parties adhere to the same non-reidentification commitments. Our use and disclosure of deidentified, anonymized, or aggregated information is not governed by this Notice. 

2.       HOW WE DISCLOSE PERSONAL INFORMATION

Panelists. We may disclose your Personal Information (in accordance with applicable law) for the purposes described above to the following categories of recipients:

  • Our Customers. If you are a Panelist, we provide data about and derived from your survey responses to some of our customers, including disaggregated data containing your Household ID, socio-demographic information, and purchase data. As described above, we develop lookalike targeted advertising models, audiences, and segments, but we do not disclose your directly identifying information to our customers for their direct marketing, targeting, or selling purposes.
  • Our Corporate Affiliates, which include our parent company and its subsidiaries listed here, the NIQ Group. For instance, we may share socio-demographic data about Panelists within the NIQ Group to help assess whether to ask you to participate in other NIQ panels, research activities, or similar opportunities. Within the NIQ Group, only employees and departments that need to process your Personal Information are granted access to it, and only to the extent necessary for research or operations purposes. The companies of the NIQ Group are either independent controllers, joint controllers or processors, depending on the processing activity.
  • Advertising, Measurement, and Analytics Providers. We may disclose Personal Information to third parties to help create models that are used to deliver and evaluate customers’ advertising campaigns. Some of our partners perform data matching operations on our and our customers’ behalf for the audience modeling processes. In addition, we may make available information from our Platforms to allow our analytics providers to help us understand how visitors use the Platforms and how to improve them. We also collect information about your interactions with emails we send to you, such as whether you forwarded the message or clicked through to our Website after opening it.

Website Visitors. We may disclose Personal Information to our advertising partners to help us recruit Panelists. We also disclose Personal Information to our analytics providers to help us understand how visitors use the Website and how to improve it.

Panelists and Website Visitors. In certain circumstances, we may disclose each category of your Personal Information to:

  • Our Service Providers. We disclose your Personal Information to our service providers that provide business, professional, or technical support services to us, help us operate our business and the Platforms, or administer activities on our behalf. We require our service providers to only use your Personal Information in connection with providing services to NIQ.
  • Governmental, Regulatory, and Public Authorities. We may disclose your Personal Information to government and law enforcement authorities to comply with legal or regulatory obligations or requests.
  • Professionals and Consultants, such as lawyers, tax consultants and auditors, as independent controllers or joint controllers, who are subject to professional secrecy or are obliged to maintain confidentiality.
  • Relevant Third Parties as Part of a Corporate Transaction. In the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with a bankruptcy or similar proceeding), we may disclose or transfer your Personal Information to certain third parties, such as the acquiring entity and its advisers.
  • Other Third Parties. We will disclose your Personal Information to other third parties at your direction or with your consent. Additionally, we will disclose your Personal Information as necessary or appropriate to: (a) comply with applicable law; (b) enforce our terms and conditions; (c) protect our operations; (d) protect our rights, privacy, safety, or property, and/or those of you or others; and (e) allow us to pursue available remedies or limit damages that we may sustain.

In addition, we may disclose your Personal Information for other reasons that we will describe at the time of information collection or prior to disclosing your information.

When we disclose Personal Information, we take contractual, technical, and organizational measures that are designed to limit the recipients’ use to specific purposes that are consistent with this Notice and in accordance with applicable law.

To the extent permitted under applicable law, we may deidentify, anonymize, or aggregate Personal Information such that there is no reasonable possibility of re-identifying you from the data used. Such deidentified data will no longer be considered Personal Information. Once deidentified, we do not attempt to reidentify the data and ensure it will not be reidentified by implementing strict technical and organizational measures and contractual measures to ensure third parties adhere to the same non-reidentification commitments. Our use and disclosure of deidentified, anonymized, or aggregated information is not governed by this Notice.   

3.         AUTOMATED DECISION MAKING, PROFILING, AND ARTIFICIAL INTELLIGENCE

Automated processes may be used to infer information about you and to create lookalike audiences. To the extent these activities constitute automated decision making or profiling, we do so in a fair and non-discriminatory manner. Note, we do not make legal or similarly significant decisions about you based on profiling, such as a decision to offer or decline your request for employment.  

Our automated processing integrates generative artificial intelligence (AI) capabilities to help us process, analyze, and summarize data more efficiently and identify key themes. We may use your aggregated data to train our proprietary AI technology and large language models (LLMs), keeping individual information private. These models predict consumer reactions, test new ideas, and guide targeted research.

NIQ maintains a steadfast commitment to the responsible, ethical, and secure application of AI technology and machine learning to enhance and evolve our business. All AI-assisted analysis is reviewed by our team to ensure accuracy and fairness. Any processing involving AI is carried out in line with data protection principles, including data minimization and transparency, and our deployment and use is subject to applicable law and NIQ’s AI Safety Policies and Guiding Principles.

4.         DATA AUTHORIZATIONS AND FINANCIAL INCENTIVES

Your Data Authorizations. You are not obligated to provide your Personal Information and can opt out/withdraw consent to our processing at any time. However, if you are a Panelist and withdraw your consent to our processing of your Personal Information, you will lose the benefits of being a Panelist.

Unsubscribing from our Marketing and Promotional Communications. From time to time, we may send you marketing and promotional communications from the NIQ Group. If you no longer wish to receive these emails from us, you may opt out by following the instructions included in any promotional or marketing email you receive from us.

Notice of Financial Incentive. Your Voice Matters — And We Thank You for It!

Your opinions matter, and so does your Personal Information. That’s why we may offer “Panel Rewards” when you participate in our Panel – it’s our way of saying thanks for your time and insights.

When you share your feedback (such as submitting receipts, scanning barcodes, and filling out surveys), you’re helping us better understand what consumers want – from shopping habits to personal preferences. This helps us create a variety of market research insights and assist our customers by better understanding consumer behavior, which in turn helps them make informed decisions about their products and services.

Panel Rewards are allocated through a points system. When you share your feedback, you gain points that can be redeemed for gift vouchers (sometimes for certain retailers or as cash-equivalent gift cards). While we don’t assign a specific dollar value to your Personal Information, the Panel Rewards we offer reflect the value your input brings – balanced against the cost of collecting data and providing the Panel Rewards program. The amount you receive may vary depending on the study and your location, but your contribution is always appreciated.

Thank you for helping us grow – and for letting us thank you in return!

Opt In Consent: We invite individuals to participate in our Panel – granting them eligibility for Panel Rewards – via online advertisements, social media outreach, and referrals from other Panelists.

Withdrawing Consent: Panelists can withdraw their consent at any time by leaving the Panel, deleting their account, or by requesting the deletion of your data, subject to our compliance obligations.

5.         PRIVACY RIGHTS AND CHOICES

In accordance with applicable law (and subject to certain exceptions), you may have certain rights in relation to your Personal Information, including the right to:

  • Access your Personal Information (including a copy in a portable format). You may have the right to request a privacy report detailing the Personal Information we maintain about you and the purposes for doing so, unless your request proves impossible or would involve disproportionate effort to fulfill. Under certain conditions, you may request that we transfer your Personal Information to another organization, or directly to you, but we may not be required to respond to your requests “to know” or access specific pieces of Personal Information more than twice in any 12-month period.
  • Request a List of Third Parties, though we will not license, publish, or sell Personal Data collected from or about you, and we are not required to provide the names of NIQ customers or other trade secrets.
  • Correct or Rectify Inaccurate Personal Information that we maintain about you, subject to appropriate verification.
  • Delete or Erase the Personal Information that we maintain about you, under certain conditions.
  • Restrict or Limit Processing of the Personal Information that we maintain about you, under certain conditions. This includes a right to restrict the use or disclosure of your Sensitive Personal Information.
  • Object to Processing the Personal Information that we maintain about you based on our legitimate interest, under certain conditions. We will no longer process your Personal Information unless we can demonstrate compelling legitimate grounds for the processing which override your interests or for the establishment, exercise, or defense of legal claims.
  • Opt Out of Sales, Sharing, or Targeted Advertising (as defined by applicable law) by navigating to “Your Privacy Rights” within the footer of our Website or the “Settings” menu in our Platforms.
  • Opt Out of Automated Processing or Profiling resulting in a decision based solely on automated processing, including profiling which produces legal effects concerning you or similarly significantly affects you. As a reminder, we do not process your Personal Information for these purposes.
  • Withdraw Consent at any time where we rely on consent as the legal basis, with effect for the future, by contacting us at or by using the contact information below.
  • Appoint an Authorized Agent on Your Behalf. Only you, or someone legally authorized to act on your behalf, may submit a request related to your Personal Information. Agents may need to demonstrate that you’ve authorized them to act on your behalf.
    • Authorization must be done in writing and signed, and the writing must identify the agent and explain what request they are authorized to make. Your agent must include a copy of this writing or a copy of a valid power of attorney with the request. The NIQ Group retains the right to request confirmation directly from you, confirming that the agent is authorized to make such a request, or to request additional information that is necessary to identify you.
  • Appeal or Lodge a Complaint in the event of a suspected infringement of applicable data protection laws, you may appeal our decision directly with us or lodge a complaint with a supervisory authority.

We empower and support the exercise of your rights. At any time, you may request or assert any of the rights listed above by navigating to “Your Privacy Rights” within the footer of our Website or the “Settings” menu in our Platforms or by using the “Contact Us” information below.

We may take steps to confirm your identity before responding to your request by asking you a series of questions about your previous interactions with us. We will work to respond within applicable legal deadlines and let you know if we need additional time. If you believe there has been a violation of your privacy rights, please contact us or the supervisory authority. We may decline a request (other than an opt-out request) if we are unable to confirm your identity (or an agent’s authority to make the request) or confirm the Personal Information we maintain relates to you.

We will not discriminate against you if you decide to exercise your privacy rights.

6.       TRANSFERS OF PERSONAL INFORMATION

Due to the international nature of our business, it may be necessary for us to transfer your Personal Information to other companies within the NIQ Group and to third parties outside the jurisdiction in which you reside that may not have the level of data protection that you enjoy under your jurisdiction (“Third Countries”). This can, for example, result in impeded enforcement of individuals’ rights, a lack of control over further processing, and access by state authorities.

Within the NIQ Group, we have concluded an intra-group data transfer agreement with the relevant transfer mechanisms (standard contractual clauses of the European Commission) and additional safeguards to ensure an adequate level of protection for your Personal Information when it is transferred to Third Countries.

Insofar as we transfer your Personal Information to other recipients in Third Countries, we ensure that your Personal Information is protected by adequate safeguards recognized by your jurisdiction (for example, by concluding standard contractual clauses of the European Commission or by means of binding corporate rules of our business partners) and supplementary measures, as necessary. You can contact us to obtain a copy of our transfer mechanisms.

7.       PERSONAL INFORMATION OF CHILDREN

We understand the importance of protecting children’s privacy. We do not knowingly collect Personal Information from children under 13 (subject to local jurisdictional age differences) without first obtaining verifiable consent from a parent or legal guardian, as required by applicable law and codes of conduct for the market research industry. We do not sell or share the Personal Information of children where prohibited by law.

Where our research activities are designed to include children, we obtain appropriate parental or guardian consent before data collection. If we learn that we have inadvertently collected or received Personal Information from children without valid consent, we will delete the Personal Information or take other steps required by applicable law. Parents or guardians may, at any time, exercise privacy rights on behalf of children.

8.       DATA SECURITY AND EXTERNAL LINKS

We maintain a comprehensive information security program with administrative, physical, and technical safeguards to maintain the confidentiality, integrity, and accessibility of your information.
